JOHN PHILLIPS (abt 1778-1860)
John Phillips was born in North Carolina in about 1778. He apparently
grew up in that state as he was married in Surry County on January 28,
1799 to Agnes Gentry. By at least 1804, they had moved to Kentucky.
The story is told that as John, his brother Edmond and other families;
possibly including the Chinns, were traveling through Kentucky when
they camped in the forest at night. On one night, they heard a noise
as something rustled the bushes near their camp. As the men
investigated to determine the source of the noise, i.e. bear, wolf,
Indian etc; they found it to be a young boy named Wilcey Walker.
After he had been fed, he explained how he happened to be running
around in the woods. He had been traveling with his parents. As he
was gathering firewood one evening, Indians raided their camp and
killed his parents. Since that time he had been wandering around in
the woods alone. When the men asked him what he wanted to do now he
said, "I want to go in that wagon there." He had pointed at the wagon
of John Phillips and continued to live with him.
The 1810 census for Kentucky included 14 men named John Phillips. The
one in Franklin County had two boys and three girls under age ten. He
and his wife were between 26 - 45 years old. This unique combination
most nearly fits that of our ancestor.
In approximately 1816, John Phillips moved to Warrick County, Indiana.
He and his wife settled on land in the north-east part of the county
and remained there for the rest of his life. He was apparently a
successful farmer as his holding eventually consisted of at least six
separate plots of land.
In 1931 a local committee was formed to compile evidence that the
Lincoln family passed through Warrick County when they moved to
Illinois in 1830. A governor's committee had earlier reported that a
"Lincoln Trail" should be established on a more northern route.
Several affidavits in the Warrick County Lincoln Route Association
report mentioned the Phillips family as follows: "At the spring near
the little Zion Baptist Church on the John Phillips farm the Lincolns
stopped to go into camp for the night. Edmond Phillips, a son of John
Phillips, saw the party there and notified his father who sent Edmond
back to invite them to come to his house and stay without cost which
they did. After Lincoln's election, Edmond often boasted that he had
one time entertained the president of the United States."
The 1850 census for Warrick County includes John Phillips at age 72
and Agnes 70 in Pigeon Township. In their household were Christopher
Posey 16 and James Posey 10.

After Agnes died on January 4, 1852, John wrote his will on April 23
as follows:
In the name of God amen I John Phillips Senr. of Warrick County,
Indiana, do make and publish this my last will and testament hereby
revoking all former wills by me heretofore made. My will and desire
is that all my just debts be paid. The proceeds of my stock of horses,
cattle, & hogs I may have at the time of my death I will and bequeath
to be equally divided between my daughter Sally Stephenson, wife of
Thomas Stephenson, Polly Reed, wife of Armer Reed, Franky Polk, wife
of William Polk, Nancy Stevens, wife of Solomon Stevens, and Agnes
Hull, wife of John Hull. All the cash on hand at my death and the
proceeds raising from the collection of debts and demands due and
owing to me of whatever nature or kindsoever after the payment of all
my just debts and funeral expenses and expenses of administration I
will and desire to be distributed as follows to Abraham Phillips Fifty
dollars and to Edmund Phillips, my son, five hundred dollars. The
balance to be equally divided between my sons Edmund and Matthew. The
North East Quarter of the North West Quarter and the North West
Quarter of the North East Quarter of Section No. nine in Township No.
four South of Range No. Seven West I give and bequeath to my son
Joseph Phillips his heirs and assigns forever. The North East Quarter
of the South East Quarter of Section No. twenty in Township No. four
South of Range six West I give and bequeath to my son William Phillips
his heirs and assigns forever. The North Half of the South East
Quarter of Section No. thirty-one in Township No. four South of Range
No. six West I give and bequeath to my son Matthew Phillips his heirs
and assigns forever. The South Half of the South East Quarter of
section No. thirty in Township No. four South of Range six West I
give and bequeath to my son Abraham Phillips his heirs and assigns.
The West Half of the South West Quarter and the South East Quarter of
the South West Quarter of Section No. thirty-one in Township No. four
(4) South of Range No. six West I give and bequeath to my son Edmund
Phillips his heirs and assigns.
And to the heirs of my son James Phillips deceased I give and bequeath
the West half of the South East Quarter of Section No. twenty in
Township No. four South of Range No. six West their heirs and assigns
Subject to the following exceptions and conditions to use. Should any
of said heirs die before they arrive of age without heirs of their
own body the surviving heir or heirs to have and possess the tract of
land last above described their heirs and assigns. But, should all of
said heirs die before they arrive of age and without heirs of their
own body then the tract of land last above described to revert back
to and be divided among my legal heirs. I hereby constitute my son
Edmund Phillips and Wait B. Moore the executors of this my last will
and testament.

I, John Phillips, do by these presents make this codicil to my last
will and testament
1st The term heirs of my son James Phillips deceased shall mean his
children to wit Lewis E., Mary, Sarah C., Agnes and Caroline Phillips.
It is also my will and desire that the above will and testament be
altered in this "that all the cash on hand at my death and the
proceeds arising from the collection of the debts and demands due and
owing to me of whatever nature or kindsoever after the payment of my
just debts and funeral expenses and expenses of administration" be
distributed as follows to wit: First I give to Abraham Phillips fifty
dollars and to Edmund Phillips five hundred dollars the balance to be
equally divided between my children Joseph Phillips, Abram Phillips,
Edmund Phillips, Matthew Phillips, Sally Stephenson, Polly Reed,
Franky Polk, Nancy Stephens and Agnes Hull.
I also desire that my executors are not to charge any of my children
